Short answer
- Dubai off-plan problems for US buyers surface in a predictable order: deposits and EOIs, payments that miss escrow, delays or cancellation, exits, handover bills, and disputes.
- Dubai law governs the purchase. The Dubai Land Department (DLD) can try to settle a dispute but cannot cancel a contract; claims go to the Dubai Courts or arbitration.
- Regulation E excludes transfers through Fedwire or a similar wire system, and no federal US scheme reimburses scam wires the way the UK does.
- Report suspected fraud to the FBI's IC3 (ic3.gov) and the FTC (ReportFraud.ftc.gov), and call your bank to ask for a recall.
Where Dubai off-plan problems for US buyers usually start
Most problems trace back to one of six stages, each with its own fix; the tables below link the 22 US guides by stage.
Six stages where an off-plan purchase can go wrong
New York is eight hours behind the UAE during daylight time and Los Angeles eleven, so same-day replies mean early calls.
…to recover our money but, as we live far away…
Stages 1 and 2: money in, before and after the SPA
The earliest payments carry the least protection. Dubai has no DLD or RERA rule on Expressions of Interest, while payments under a signed Sales and Purchase Agreement (SPA) must go into the project's escrow account under Dubai Law No. 8 of 2007.
| What happened | Guide |
|---|---|
| Weighing an EOI before a launch | How Dubai EOIs work for American buyers |
| EOI paid, refund delayed or refused | Recovering an EOI payment from the US |
| Booking deposit kept | Reservation fee and booking deposit refunds |
| Paid in cash at a sales office | Cash deposits handed to a Dubai developer |
| About to wire an installment | Matching the escrow account before you wire |
| Wire went to a non-escrow account | Off-plan money sent outside escrow |
| Next payment due | Checking construction progress before paying |
| Missed an installment | The DLD notice and 30-day window after a missed payment |
Stages 3 and 4: when the timeline breaks or you want out
Dubai sets no automatic compensation for delay; your SPA decides. If RERA cancels a project, all payments must be refunded, subject to what remains in escrow. Leaving has a defined price: under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, a developer terminating for buyer default may keep up to 25% of the unit value below 60% whole-project completion, and up to 40% from 60%.

Stages 5 and 6: handover, running costs and disputes
At handover, inspect before signing and compare service charges with the RERA-approved rate. In a dispute, the DLD can mediate, but only a court or arbitrator can terminate a contract or award compensation.
| What happened | Guide |
|---|---|
| Keys are close | A pre-handover inspection list |
| First bill is above the brochure | Service charges higher than you were told |
| Want the approved rate | Using RERA's Service Charge Index from abroad |
| Emails go unanswered | Escalating when the developer stops responding |
| Ready to escalate | Choosing between DLD settlement, court and arbitration |
If a Dubai property went wrong for US buyers: the home-side playbook
US agencies take fraud reports and banks can request recalls; neither can decide a Dubai contract dispute.
Call your bank
The FBI's IC3 says to contact the originating financial institution as soon as fraud is recognized to request a recall or reversal.File with IC3 and the FTC
IC3 at ic3.gov is the main intake for cyber-enabled fraud and can, in some cases, help freeze stolen funds. Also report at ReportFraud.ftc.gov.Avoid travel surprises
The State Department warns people can be barred from leaving the UAE until legal cases are settled, and bounced checks can bring imprisonment or fines.
Investor.gov lists "wire transfer abroad" among fraud red flags. US citizens and resident aliens are taxed on worldwide income, and an FBAR is due if foreign financial accounts exceed $10,000 at any time in the year (general information only, not tax advice).
