Short answer
- Compensation for a delayed handover in Dubai is not automatic for US investors or anyone else: it depends on the SPA's terms or a decision by a court with jurisdiction in Dubai.
- Damages generally need proof of breach, actual loss and a causal link (HAS Law Firm, July 2026).
- Claims up to AED 500,000 (about $136,147 at the fixed 3.6725 peg) go first to the Dubai Courts' Centre for Amicable Settlement of Disputes.
Compensation for delayed handover in Dubai: what US investors should know first
Dubai law does not set automatic compensation for late handover. Whether you are owed anything depends on your SPA and, if disputed, on a court or arbitrator. Build the claim file before you pay lawyers across an 8-to-12-hour time gap.

Step 1: Does my SPA set an off-plan delay penalty for the developer?
Only your SPA can give you a fixed delay penalty; Dubai statute does not. Read the completion date, any penalty, the extension clause and force majeure together.
Many SPAs let the developer extend the completion date, often by up to 12 months. A lawyer writing in Khaleej Times cites Civil Transactions Law Art. 246(1): contracts are performed according to their terms and in good faith.
Step 2: How do I prove the handover is actually late?
Compare the SPA date, plus any extension, with the Dubai Land Department (DLD) record. The DLD's Dubai REST app and website show the projected completion date and completion percentage.
RERA's technical auditor charges AED 15,000 per unit (about $4,084) for a completion report, or you can compare the project's registry dates first.
Step 3: What counts as a provable loss for a late handover compensation claim?
A documented loss linked to the delay is the core of any claim. HAS Law Firm writes that "not every delay automatically entitles a buyer to terminate the contract", and that compensation requires proof of breach, actual damage and a causal link.

Step 4: Should I try settlement before going to court?
Yes. A written settlement request costs little and comes first. The DLD can try an amicable settlement, and one it approves is binding (Khaleej Times, citing ECR 6/2010). The DLD cannot cancel your contract.
Step 5: Which forum hears a late handover compensation claim from US buyers?
The forum depends on the claim size and your SPA. Clyde & Co reports that the Dubai Courts' Centre for Amicable Settlement of Disputes has exclusive first-step jurisdiction over claims up to AED 500,000. The firm does not spell out how this applies to real estate.
| Route | What it can do | Note for US investors |
|---|---|---|
| DLD conciliation | Broker a binding settlement | Cannot award damages or cancel |
| Centre for Amicable Settlement | First step for claims up to AED 500,000 | About $136,147 at the peg |
| Dubai Courts | Rule on breach and damages | Hearings on Dubai time |
| Arbitration | Only if the SPA has a clause | Read the seat and rules |
Step 6: What do US investors handle on the home side?
US agencies do not decide Dubai contract claims, but three US-side points matter. First, embassies can provide attorney lists but "may not recommend a particular foreign attorney", per the State Department.
Second, the IRS says US citizens and resident aliens are "subject to tax on worldwide income from all sources", so ask a US tax adviser about any settlement (general information only).
Third, lawyer calls run on Dubai time, 8 to 12 hours ahead of the continental US coasts. The worldwide view is in our compensation pillar; every American-focused topic sits in the US hub. Also useful: first moves on a delayed project and what to do when the developer goes quiet.
