Compensation for a delayed handover in Dubai: what decides it

Compensation for delayed handover in Dubai is not automatic. See how SPA terms, force majeure and the courts decide whether a late developer owes you.

By HomeProof Research TeamUpdated 7 min readDubai law · every fact with a source

Short answer

  • Dubai law does not set automatic compensation for delayed handover; any payment depends on your SPA and, if disputed, on a court or arbitrator.
  • A lawyer writing in Khaleej Times (2024) points to Civil Transactions Law Article 246(1): contracts are performed according to their terms and in good faith.
  • Many SPAs let the developer extend the completion date, often by up to 12 months, before any delay counts as late.
  • To win compensation, a buyer must show a breach, actual damage and a causal link between them, according to HAS Law Firm (2026).
  • The DLD can try an amicable settlement but cannot cancel a contract; claims go to the Dubai Courts or to arbitration.

Whether you can get compensation for a delayed handover in Dubai comes down to two documents and one forum: your SPA, your evidence of loss, and a court or arbitrator if the developer does not agree.

Next: what contracts usually say, what the law adds, what a claim must prove and which routes exist. Other emirates set their own rules.

Is compensation for delayed handover in Dubai automatic?

No. Dubai law does not set automatic compensation for late handover. Whether you are owed anything depends on your SPA and, if disputed, on a court or arbitrator.

Khaleej Times (December 2024), in a piece written by a lawyer, sets out the legal frame:

  • Civil Transactions Law, Article 246(1): contracts are performed according to their terms and in good faith
  • Article 295: damages are generally paid as money
  • ECR 6/2010, Article 14: the DLD may conciliate between developer and buyer
  • ECR 6/2010, Article 21: force majeure can be raised as a defense
  • Law 13/2008, Article 13: the DLD can refer developer violations for investigation

ECR 6/2010 is Executive Council Resolution No. 6 of 2010, the implementing rules for Dubai's interim property register law. Its article numbers here come from law-firm and press summaries.

Delay damages in a Dubai SPA: what does your contract say?

Your Sale and Purchase Agreement (SPA) is the first and usually decisive source. It may contain a delay-penalty clause, a cap on liability, an extension right and a force-majeure list, and each one changes what you can claim.

Clauses to find in your SPA

SPAs typically allow the developer to extend the anticipated completion date, often by 12 months, according to Afridi & Angell (2019); BSA, quoted in Arabian Business, cites 6 to 12 months depending on the contract. A delay inside that window is generally not a breach.

What does a buyer have to prove to get delay compensation?

A buyer has to prove three things: a breach, actual damage and a causal link between the two. HAS Law Firm (July 2026) lists these as the requirements for compensation in Dubai off-plan disputes.

  1. Breach

Show that the contractual completion date, including any extension, has passed without handover, and that no valid force-majeure event explains it.
  2. Damage

Show a real, measurable loss. Rent paid while waiting, lost rental income or extra financing costs are the kinds of losses buyers raise.
  3. Causation

Link that loss directly to the late handover, with dated receipts, leases and correspondence.

Courts also weigh the reasons for the delay, force majeure, actual progress on site and the developer's conduct, according to the same firm. A developer that kept building and communicating is treated differently from one that stopped work.

When can force majeure excuse a late handover in the UAE?

Force majeure can excuse a delay when the event fits the SPA's definition and the law's examples. Dubai's ECR 6/2010, Article 21, as summarized by a property portal, lists expropriation, a government suspension for re-planning, obstacles found on site, changes by the master developer and other reasons RERA decides.

Off-plan rules differ by emirate, and this section covers Dubai. Ask the developer in writing which event it relies on and from what date. A vague reference to "market conditions" is something to put to a lawyer.

Which routes lead to compensation?

Three routes lead to compensation: an agreed settlement, DLD conciliation, or a court or arbitration claim. Each one is slower and more formal than the last.

The Dubai Courts' Centre for Amicable Settlement of Disputes has exclusive first-step jurisdiction over claims up to AED 500,000, under Law 18 of 2021 and Resolution 4 of 2025, according to Clyde & Co (2025). The firm does not spell out how that applies to real estate, so confirm it with a lawyer.

UK government advice notes that in Dubai cases can take many months and, on occasions, years. Article 11(g) of Law No. 13 of 2008, as amended by Law No. 19 of 2020, keeps every buyer's right to go to court or arbitration.

Should you terminate instead of claiming compensation?

Termination and compensation are different remedies. A buyer may apply to court to terminate for delay under ECR 6/2010, Article 20, according to Afridi & Angell, but HAS Law Firm notes that not every delay automatically entitles a buyer to terminate.

Stopping payments in protest is not termination. It can let the developer start its own process under Article 11 and keep part of the unit value. The full set of exits is in our guide to canceling an off-plan contract.

Is late handover compensation in the UAE set by law?
Late handover compensation is not set at a fixed rate by Dubai law. Whether a Dubai developer owes anything depends on the SPA's terms and, if disputed, on a court or arbitrator. Other emirates have their own rules. Read your contract's delay, extension and force-majeure clauses before making any claim.
Can I claim rent I paid while waiting for a delayed handover?
Rent paid while waiting for a delayed Dubai handover is the kind of loss buyers raise, but it has to be proved. HAS Law Firm says compensation requires a breach, actual damage and a causal link. Keep the lease, rent receipts and dated messages showing the handover was due and missed.
What is an off plan delay penalty for a developer?
An off plan delay penalty is a payment a developer agrees in the SPA to make if handover is late. It exists only if the contract includes one. The clause may fix a rate, cap the total or limit the buyer to that remedy, so read the exact wording.
Can the DLD order a developer to pay delay damages?
The Dubai Land Department can try to reach an amicable settlement between buyer and developer, and a settlement it approves is binding. The DLD cannot cancel a contract at a buyer's request. Termination or compensation claims go to the Dubai Courts, or to arbitration if the SPA provides for it.
How long does a delay compensation case take in Dubai?
No official average exists for Dubai delay compensation cases. UK government advice says Dubai cases can take many months and, on occasions, years to conclude. Claims up to AED 500,000 first pass through the Dubai Courts' Centre for Amicable Settlement of Disputes, according to Clyde & Co.
