Short answer
- Dubai has no general cooling-off right to cancel an off-plan contract; every exit runs through resale, agreement, a court or the developer's default process.
- Reselling before handover needs a developer No Objection Certificate (NOC), and many SPAs require 30–40% of the price paid first, which is developer policy, not law.
- An agreed cancellation can be recorded as a signed SPA addendum, including through DLD mediation.
- A buyer may ask a court to terminate for the developer's breach under ECR 6/2010, Article 20, but not every delay qualifies.
- Simply stopping payments lets the developer terminate and keep up to 25% or 40% of the unit value under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020.
Buyers who want to cancel an off-plan contract in Dubai usually discover there is no single "cancel" button. There are four or five distinct exits, each with its own cost, timeline and paperwork, and the cheapest one depends on how much you have paid and how far the project has been built.
The comparison below assumes a signed, registered Sale and Purchase Agreement (SPA) on a project in Dubai. It is not legal advice.
Can you cancel an off-plan contract in Dubai at all?
Yes, but not unilaterally and not for free. No verified Dubai rule gives buyers a general right to walk away after signing; an exit happens by selling the contract on, agreeing terms with the developer, winning in court or arbitration, or being terminated after default.
…ask for a refund of the amount I have already paid?
One route is not available: the DLD itself cannot terminate a contract at the investor's request. Its FAQ says its role is limited to amicable settlement and that termination belongs in the real estate court.
What are the ways to exit an off-plan purchase in Dubai?
The main exits are resale, mutual cancellation, court or arbitration, and buyer default. A fifth outcome, a full refund, applies only when RERA cancels the project or work never started.
| Exit | What it needs | Typical cost to you | Main risk |
|---|---|---|---|
| Resale before handover | Developer NOC; often 30–40% paid | NOC admin fee and transfer costs | Developer policy can block or delay the NOC |
| Mutual cancellation | Developer's agreement, in writing | Whatever the settlement says | No obligation on the developer to agree |
| Court or arbitration | Proof of developer breach | Legal fees and time | Courts weigh delay reasons and force majeure |
| Stopping payments (default) | Nothing; developer acts | Up to 25% or 40% of the unit value | Least control over the outcome |
| RERA cancellation or work not started | Regulator decision or no start on site | None in law: full refund | Recovery depends on escrow |
How does resale work as an exit?
Resale lets someone else take over your contract, so the developer receives the remaining payments from the new buyer. Law No. 13 of 2008, Article 6, allows registered off-plan units to be disposed of by sale, mortgage or any other legal disposition.
The developer's consent is the gate. The DLD's FAQ says assigning the unit or contract to a third party is possible only after obtaining a No Objection Certificate (NOC) from the developer.

Resale is covered step by step in selling off-plan before handover. If the developer will not issue the certificate, see what to do when a developer refuses a NOC.
Can you agree a cancellation with the developer?
Yes, if the developer is willing. A negotiated cancellation can set any refund the two sides accept, and the DLD may mediate. Under Law No. 19 of 2020, a settlement reached through DLD mediation during a default notice is attached to the SPA as a signed addendum.
…I asked for a refund, the developer said he will deduct 60 per cent
Can you terminate an SPA in Dubai as a buyer through the courts?
A buyer may apply to court to terminate for the developer's breach, for example serious delay, under ECR 6/2010, Article 20, according to Afridi & Angell. If the SPA has an arbitration clause, the claim goes to arbitration instead. Article 11(g) of Law No. 13 of 2008, as amended by Law No. 19 of 2020, keeps both routes open.
HAS Law Firm (2026) cautions that not every delay automatically entitles a buyer to terminate. Courts weigh the completion date, the reasons for delay, force majeure, actual progress and the developer's conduct. Compensation needs proof of breach, actual damage and a causal link.
What happens if you just stop paying?
Stopping payments hands the decision to the developer. Under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, the developer notifies the DLD, which gives the buyer 30 days to pay; after that, the developer may terminate.
The percentages apply to the unit value in the contract, not the amount you paid. The tiers are worked through with examples in the 25% and 40% termination rules; missed-payment steps are in what happens after a missed off-plan payment.
How do you choose the least costly exit?
Start from two numbers: how much of the price you have paid, and the whole project's completion percentage in the official record. Those two figures decide which exits are open and roughly what each costs.
Get the completion figure
Open Project Status (Mashrooi) in the DLD's Dubai REST app and note the completion percentage and status.Total your payments
Add up every receipt and check each went into the project escrow account.Read the SPA exits
Find the resale threshold, NOC terms, termination clause and dispute clause.Price each route
Compare the resale costs, any settlement offer and the Article 11 tier for your project.
Checking takes minutes; not checking can cost everything. You can look up the project's official record before you speak to a lawyer or the developer.
