Short answer
- With an off plan project delayed in Dubai, what to do from the US comes down to records: confirm the official date, read the SPA, keep paying, document everything.
- Dubai law sets no automatic compensation for late handover; your SPA and, in a dispute, a court or arbitrator decide.
- Stopping installments can start termination under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, with the developer keeping up to 25% or 40% of the unit value.
- Dubai is 8 hours ahead of New York and 11 ahead of Los Angeles until November 1, 2026.
Off plan project delayed in Dubai: what to do from the US
A late Dubai project calls for verification and a paper trail, not a payment strike. Six steps follow.
Confirm the delay on the official record
Look up the completion date the Dubai Land Department holds.Read the SPA's extension clause
Find the extension right and force-majeure wording.Keep paying and keep wire proof
A missed installment can start the Article 11 process.Build a two-time-zone paper trail
Write, and log each message in UAE and US time.Escalate in the right order
Developer, then DLD conciliation, then a UAE-qualified lawyer.Use US channels for what they cover
IC3 and the FTC take fraud reports.
Step 1: Where is the official completion date?
The Dubai Land Department (DLD) keeps the projected completion date and completion percentage for registered projects. Its Dubai REST app adds site photos and the last inspection date.
The app's notes say foreign investors log in with UAE PASS or a title deed. Off-plan buyers rarely hold a deed, so most use UAE PASS, the national digital ID, which has a passport-based Visitor path.
No app access? Search the DLD website by project name or number, or check a project's registry record in one place.
Step 2: What does the SPA allow the developer to do?
Your SPA (sale and purchase agreement) is the contract that decides whether a delay is a breach. Law firms report that many SPAs let the developer push the anticipated completion date back, often by up to 12 months. Check the extension and force-majeure clauses side by side.
…I had to pay rent for over a year due to the delay.
Step 3: Should I keep paying installments while the project is late?
Usually yes, because withholding payment makes you the party in default. Under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, the DLD serves a 30-day notice, then the developer may terminate and keep up to 25% of the unit value below 60% completion of the whole project, or up to 40% from 60%.
Wire records matter for US buyers. Regulation E, the federal consumer electronic-transfer rule, excludes transfers "through Fedwire or through a similar wire transfer system", so your own file is the main evidence. Save every confirmation.
Step 4: How do I document contact across two time zones?
Put everything in writing and stamp each message with both clocks. A 7:00 a.m. New York call lands at 3:00 p.m. in Dubai during daylight time; from Los Angeles that slot means 4:00 a.m.
| US city | Until Nov 1, 2026 | From Nov 1, 2026 |
|---|---|---|
| New York (Eastern) | 8 hours (EDT) | 9 hours (EST) |
| Los Angeles (Pacific) | 11 hours (PDT) | 12 hours (PST) |
Step 5: Who do I escalate to, and in what order?
Escalate from the developer to the DLD to a lawyer, keeping copies at each stage. The DLD can try an amicable settlement but cannot cancel your contract; termination or compensation claims go to the Dubai Courts, or to arbitration if the SPA says so.
Step 6: What can US agencies do about a Dubai off-plan delay for American buyers?
A delay on its own is a contract matter, so US agencies have a narrow role. If it comes with signs of fraud, such as money requested outside escrow, report to the FBI's IC3 at ic3.gov and to the FTC at ReportFraud.ftc.gov.
The State Department can list UAE attorneys, but embassies "may not recommend a particular foreign attorney" and "do not provide legal advice to the public".
