Off-plan project delayed in Dubai: what to do as an investor in Canada

Off-plan project delayed in Dubai? What to do as a Canada investor: a 30-day timeline, Dubai REST checks from Toronto or Vancouver, and records to keep.

Short answer

  • Dubai law sets no automatic compensation for a late handover; your SPA and, in a dispute, a court or arbitrator decide whether anything is owed.
  • The Dubai Land Department's Dubai REST app shows a registered project's status, completion percentage and projected completion date. From Canada you will usually need a UAE PASS "Visitor" account to sign in.
  • Many SPAs let the developer extend completion, often by up to 12 months.
  • Holding back instalments can open termination under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020.
  • Dubai is 8 hours ahead of Toronto until 1 November 2026, then 9; it is 11 hours ahead of Vancouver all year.

Your off-plan project is delayed in Dubai and you are working out what to do from Canada. Start with the government record, not the sales office. Canada investors face two extra hurdles: an 8- to 11-hour time gap and an app login built around UAE identity. This page covers Dubai only.

What should Canada investors do first about a delayed Dubai off-plan project?

Record what the Dubai Land Department (DLD) shows today, before contacting anyone. The registry's projected completion date and completion percentage are the neutral benchmark for every later email.

Phase 1: capture the official record

Dubai off-plan delay: what buyers in Canada see in the app

Each project carries an active, finished or cancelled label, according to Gulf News (2023). RERA, the DLD's regulatory arm, periodically asks developers to update the expected completion date, so the date you see can move.

Does your SPA let the developer move the date?

Usually, within limits. The Sale and Purchase Agreement (SPA) is your signed contract with the developer, and many SPAs allow the completion date to be extended, often by 12 months, according to Afridi & Angell.

…the developer promised a completion date of 2019.

Phase 2: read the contract

How do you reach a Dubai developer across an 8- to 11-hour gap?

Write rather than phone, and time messages to land in UAE office hours. The UAE stays on UTC+4 all year with no daylight saving time.

How far ahead Dubai is
CityUntil 1 Nov 2026From 1 Nov 2026
Toronto8 hours9 hours
Vancouver11 hours11 hours

British Columbia moved to permanent Pacific time, fixed at UTC−7, in March 2026, so Vancouver clocks will not fall back this November. A 09:00 start in Dubai is 22:00 the previous evening in Vancouver.

Phase 3: the written question

Should you keep paying while the off-plan handover is delayed?

Keep to the schedule unless a lawyer advises otherwise in writing. A buyer's default lets the developer start termination under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, whatever the reason for the delay.

The DLD FAQ says an investor can ask for a letter from the DLD-approved project consultant confirming the completion percentage before paying a developer's request. See the pre-payment progress check for Canadian buyers.

When does a late handover become a dispute?

A delay becomes a dispute when written answers stop matching the registry. The DLD may try an amicable settlement but cannot cancel your contract; termination claims go to the real estate court.

If the project was marketed to you in British Columbia, BCFSA says its Real Estate Development Marketing Act covers developments anywhere in the world and it can investigate complaints. Continue with whether compensation is owed, the delay guide for all buyers and the Canadian buyers' hub, or compare the developer's dates with the official record.

My off-plan handover is delayed. What can Canadian buyers check first?
Canadian buyers with a delayed off-plan handover can open Dubai REST, choose Project Status (Mashrooi) and note the projected completion date, completion percentage and last inspection. Login from abroad usually requires UAE PASS as a Visitor. Then set that date beside the anticipated completion date and the extension clause in the SPA.
Is a Dubai off-plan delay enough to get my money back?
A Dubai off-plan delay is not, on its own, a right to a refund. Many SPAs allow the developer to extend completion, often by up to 12 months. A buyer can apply to court to terminate, but courts weigh the reasons, force majeure, actual progress and the developer's behaviour.
What time should I email a Dubai developer from Toronto or Vancouver?
An email to a Dubai developer arrives at the start of the UAE working day if sent around 01:00 Toronto time under daylight time, or 22:00 the previous evening in Vancouver. Dubai is 8 hours ahead of Toronto until 1 November 2026, then 9, and 11 hours ahead of Vancouver year-round.
Can a Canadian consulate push the developer to finish?
No. Under the Canadian Consular Services Charter, consular officials cannot give legal advice or intervene in private legal matters such as a contract dispute with a developer. They can provide a list of local lawyers. The contacts are the Consulate General of Canada in Dubai and the Embassy in Abu Dhabi.
