Short answer

  • If RERA cancels a Dubai off-plan project, the developer must refund all payments buyers made, under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020.
  • Al Tamimi's summary of the rules: escrow money on hand is refunded within 14 days of cancellation, and the developer pays any shortfall within 60 days, which RERA can extend.
  • Recovery depends on what is left in escrow, and the DLD calls the liquidation timeline indefinite.
  • For a Dubai off-plan project cancelled, the refund for US buyers rests on full wire records.

Dubai off-plan project cancelled: how the refund works for US buyers

A RERA cancellation creates a legal right to a full refund, but how much and how fast you are paid depends on the escrow account. The next weeks are paperwork.

  1. Confirm the cancellation is official

Check the project label in the DLD record.
  2. Gather proof of every dollar paid

    Wires, receipts, SPA, Oqood certificate.
  3. Understand the refund sequence

Escrow first, then the developer's shortfall.
  4. Watch for the liquidation track

Some projects move to a special tribunal.
  5. Set up how the refund reaches you

    Account, currency, US reporting.

Step 1: Has RERA really cancelled the project?

A project counts as cancelled only after RERA issues a final, reasoned decision. RERA, the Dubai Land Department's regulator, may cancel for not starting work without good reason, escrow-law offences, bankruptcy or no genuine intention to build.

The Dubai REST app labels each project active, finished or cancelled. Can't log in from the US? Look up the project's registry status before acting on rumors.

Step 2: What records prove my payments from the US?

Your wire confirmations, receipts and SPA set your share of any refund.

Step 3: What happens to my money when RERA cancels a Dubai project?

Escrow funds on hand go back first, and the developer must cover the rest. Al Tamimi's summary of Executive Council Resolution 6 of 2010 sets this sequence:

Refund sequence after a RERA cancellation (per Al Tamimi, 2013)

Day 0
RERA issues the cancellation decision
Within 7 working days
Developer may appeal; RERA's rejection is final
Within 14 days
Available escrow funds refunded to buyersAn auditor is appointed at the developer's cost
Within 60 days
Developer pays any shortfallRERA can extend this
After non-payment
RERA refers the matter to the judicial authorities

Escrow protects how your money is used; it does not ensure completion. Under Law No. 8 of 2007, the developer's creditors cannot seize escrow deposits, but buyers may become unsecured creditors once escrow runs out, a law-firm review notes.

Step 4: When does a cancelled project go to liquidation?

Some cancelled projects move to the Special Tribunal for Liquidation of Cancelled Real Property Projects, created by Decree No. 33 of 2020. Its decisions are final and are enforced by the Dubai Courts' Execution Court.

The DLD's liquidation section distributes escrow funds "in full or proportionally" depending on what is available, and the DLD FAQ calls the expected timeline indefinite. See our US guide to the liquidation track.

Today's outcome depends on your project's escrow balance.

Step 5: How will a refund reach me in the US?

Decide where the refund lands and what it triggers at home. The dirham has been pegged at 1 USD = AED 3.6725 since February 2002, so example: a hypothetical AED 367,250 refund equals $100,000.

A UAE bank account can create a US filing duty. The IRS requires an FBAR, filed with FinCEN, if foreign financial accounts total more than $10,000 at any time in the year; it is due April 15, extended automatically to October 15. General information only.

Rera cancelled project refund for American buyers: when to involve US agencies

A lawful cancellation is a Dubai process, so US agencies play no part unless there are signs of fraud. If you were asked to pay outside escrow, report it to the FBI's IC3 at ic3.gov and the FTC at ReportFraud.ftc.gov, and call your bank.

The State Department can list UAE attorneys but cannot recommend one. Background reading: what happens to buyer money in a cancellation, all guides for buyers in America and the US playbook when a developer stops replying.

Do US buyers get a full refund when a Dubai project is cancelled?
US buyers have the same legal right as other buyers when RERA cancels a Dubai project: Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, requires the developer to refund all payments. How much comes back depends on the escrow balance and the developer covering any shortfall.
Cancelled project in Dubai: what happens to my money from the US?
When a Dubai project is cancelled, money in its escrow account is refunded first, within 14 days per Al Tamimi's summary, and the developer must pay any shortfall within 60 days. Buyers in the US receive refunds through the same process, so keep wire confirmations and the SPA ready to prove each payment.
How long does a Dubai cancelled-project refund take?
A Dubai cancelled-project refund can be quick if escrow holds enough money, but projects sent to liquidation have no fixed end date. The DLD FAQ describes the liquidation timeline as indefinite, depending on complete documents, amounts and eligible persons, so buyers should keep their records ready.
Do I need to file an FBAR because of a Dubai refund?
An FBAR is needed when a US person's foreign financial accounts total more than $10,000 at any time in the year. If a Dubai refund is paid into a UAE bank account that crosses that level, an FBAR may be required, filed with FinCEN. General information only; confirm with a US tax adviser.
