Is an expression of interest for Dubai property refundable? A pre-payment playbook for American buyers

Is an expression of interest for Dubai property refundable for American buyers? What an EOI is, who holds the money, and Dubai vs Abu Dhabi rules in 2026.

By HomeProof Research TeamUpdated 5 min readDubai law · every fact with a source

Short answer

  • Whether an expression of interest for Dubai property is refundable for American buyers depends on the developer's own terms; no official Dubai rule on EOI refunds was found.
  • An EOI is an early payment that registers interest in an off-plan launch, usually before a unit is allocated or an SPA is signed.
  • In Abu Dhabi, since February 16, 2026, EOIs must be registered on ADREC's Madhmoun platform, with funds held in a supervised escrow account.
  • At exhibitions, Dubai's ad-permit rules allow only preliminary reservations, not sales.
  • The SEC's Investor.gov lists pressure to invest now and requests to pay by "wire transfer abroad" as red flags.

The best time to ask questions about an EOI is before the wire leaves your US bank.

Is an expression of interest for Dubai property refundable for American buyers?

Only if the developer's written terms say so. In Dubai, EOI terms, including whether and when the money is refundable, are set by the developer, so get the refund terms in writing and know who is holding the money before you pay.

What is an EOI in Dubai, for US investors?

An EOI, or expression of interest, is money paid to register interest in a project launch, typically before a specific unit is allocated and before the SPA (sale and purchase agreement) is signed. It is not a registered purchase. Under Dubai Law No. 13 of 2008, Article 3(1), a sale of an off-plan unit is void unless entered in the Interim Property Register.

  1. Confirm the project is registered

    Check Dubai REST before paying.
  2. Scan the ad's QR code

Madmoun shows if the ad is permitted.
  3. Get refund terms in writing

    Amount, deadline, conditions.
  4. Name the account holder

    Developer, broker or escrow.
  5. Wire, then file the proof

Keep the confirmation and terms together.

Step 1: Confirm the project exists in DLD records

The DLD's ad-permit rules say advertisers may not showcase off-plan properties that are not registered with the Escrow Account Department. In June 2024, the DLD fined three developers AED 500,000 each (about $136,000) for marketing unregistered off-plan projects.

Step 2: Check the ad and the event

Since April 24, 2023, every Dubai property ad permit issued through Trakheesi carries a Madmoun QR code that shows whether the ad is RERA-approved and valid.

Step 3: Get the refund terms in writing

Ask for a document that states the EOI amount, whether it is refundable, by when, and on what conditions, for example if you decline the unit offered. A verbal promise is hard to enforce from the US.

If the pitch promises fixed rental income or a managed rental pool, note SEC Release 33-5347: condominium units can become securities when sold with an emphasis on returns from the promoter's rental management or with rental pools. The SEC's Investor.gov red-flag list also includes promised returns and unlicensed sellers.

Step 4: Know who will hold the EOI payment

Dubai's escrow rules cover off-plan buyer payments, but no source confirms that money paid before an SPA falls under them. Ask which entity's account receives the money, and whether it is the project escrow account. Our escrow verification playbook shows how to check an account number.

Step 5: Wire with your eyes open

Regulation E excludes Fedwire and similar wire systems from its consumer protections. The CFPB's remittance rule lets you cancel within 30 minutes unless the money has been deposited.

Dubai is 8 to 9 hours ahead of New York and 11 to 12 ahead of Los Angeles, depending on US daylight saving time, so launch-day deadlines often fall overnight in the US. If you have already paid and want the money back, read getting an EOI refund or, after signing, the booking deposit refund guide. The global EOI explainer and the American buyers' starting page have more, and you can check a developer's registry record any time.

EOI questions from US buyers before a launch

What is an EOI in Dubai for US investors?
An EOI in Dubai is an expression of interest: an early payment that registers interest in an off-plan launch, usually before a unit is allocated or an SPA is signed. For US investors it is not a registered purchase, because Dubai Law No. 13 of 2008 makes an off-plan sale void unless entered in the Interim Property Register.
Should US buyers make an EOI payment for an off-plan launch?
Before making an EOI payment for an off-plan launch, US buyers should confirm the project is registered in DLD records, scan the ad's Madmoun QR code, get the refund terms in writing and identify the account holder. The SEC's Investor.gov lists pressure to invest now and wire transfers abroad as red flags.
Are Abu Dhabi EOI rules different from Dubai's?
Abu Dhabi EOI rules are different. ADREC announced on February 16, 2026 that developers of new off-plan projects must register EOIs on its Madhmoun platform, with funds held in a government-managed preparatory escrow account. No equivalent Dubai rule was found, so in Dubai the developer's terms govern.
Can I pay an EOI at a Dubai property expo in the US?
The DLD's ad-permit rules say only preliminary reservations, not sales, are allowed at exhibitions. A Dubai property expo held in the US is still a marketing event, so any EOI paid there runs on the developer's written terms. Ask for those terms and the account name first.
