Short answer

  • Dubai off-plan problems for Australian buyers follow the purchase: getting in, instalments, delays or cancellation, getting out, handover costs, and disputes.
  • Dubai law governs the contract. Off-plan payments belong in the project's escrow account, and the Dubai Land Department (DLD) can attempt a settlement but cannot cancel a contract.
  • Australia's Scams Prevention Framework did not create UK-style mandatory reimbursement, and none of its sources cover transfers to an overseas recipient.
  • Report scams to Scamwatch, use ReportCyber if money was stolen, and contact your bank immediately to ask it to stop the transaction.

How do Dubai off-plan problems for Australian buyers unfold?

They follow the purchase; the earlier the stage, the thinner the paperwork.

Stages 1 and 2: money paid to get in, and instalments

The common early problems are refunds and payments that never reached escrow. In Dubai, EOI terms are set by the developer, while payments under a signed contract go into the project's escrow account.

Stages 3 and 4: waiting, and getting out

Late projects are judged against your SPA, which often lets the developer extend completion by up to 12 months. Leaving early has a cost set by Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020: up to 25% of the unit value below 60% whole-project completion, up to 40% from 60%.

Stages 5 and 6: handover costs and disputes

The DLD says owners need not pay common service charges that RERA has not approved. In a dispute, the DLD can attempt settlement, but claims go to the Dubai Courts or arbitration.

When a Dubai property went wrong for Australian buyers: what to do at home

Australian channels can record a scam and help with identity recovery, but cannot decide a Dubai contract dispute.

  1. Call your bank

Scamwatch advises contacting your bank immediately and asking it to stop transactions. An international recall may not succeed.
  2. Report it

Report scams to Scamwatch, and use ReportCyber if money or personal information was stolen. IDCARE helps with identity misuse.
  3. Find a Dubai lawyer

The Australian Consulate-General Dubai publishes a list of legal practitioners; it does not endorse anyone listed.

Still buying off-plan in Dubai from Australia? Consumer Affairs Victoria warns about spruikers promoting off-the-plan property that does not yet exist. Australian residents must declare income earned anywhere, including overseas rent, and CGT may apply on sale (general information, not tax advice).

What are typical Dubai off-plan problems for Australian buyers?
Typical Dubai off-plan problems for Australian buyers are unrefunded EOIs or deposits, payments outside escrow, delayed or cancelled projects, expensive exits, rising service charges and slow disputes. Dubai law governs each one. Australian scam protections are still being phased in and do not clearly cover transfers to a UAE account.
Is buying off plan in Dubai from Australia covered by bank scam refunds?
Buying off plan in Dubai from Australia is not clearly covered by bank scam refunds. The Scams Prevention Framework did not create mandatory reimbursement, its main bank obligations start no earlier than 31 March 2027, and none of its sources address payments to an overseas recipient. Ask your bank about a recall straight away.
Can DFAT help if my Dubai property went wrong?
If a Dubai property went wrong, DFAT consular officials cannot give legal advice or intervene in another country's legal matters, including commercial disputes. The Australian Consulate-General Dubai publishes a list of local legal practitioners, without endorsing anyone. The dispute itself goes through the DLD, the Dubai Courts or arbitration.
