Short answer
- For an EOI refund in Dubai, buyers in Australia should start from the written terms: no official DLD or RERA rule on EOI refunds was found, so the developer's terms govern.
- No verified source says Dubai EOI money must go into escrow; whether a pre-SPA EOI counts as an off-plan buyer payment is not confirmed.
- Abu Dhabi is different: under rules announced in February 2026, ADREC requires investor EOIs to be registered on its Madhmoun platform, with funds held in a supervised escrow account.
- The DLD can attempt amicable settlement but cannot cancel a contract; termination or money claims go to the Dubai Courts, or arbitration if a clause applies.
- If the payee looks fake, call your Australian bank first, then report to Scamwatch and ReportCyber.
An EOI (expression of interest) is a payment that reserves a place in the queue for a new launch, usually before any sale contract exists. Getting it back depends on three facts: which emirate, what the receipt and terms say, and whether the payee was who you thought. A quick registry check on the project helps with the last one.

How does an EOI refund in Dubai work for buyers in Australia?
An EOI refund in Dubai works on the developer's own terms, because no DLD or RERA rule on EOIs has been found. Buyers in Australia need the written terms, proof of who received the money, and a dated paper trail before anything else can move.
The safe framing is simple. In Dubai, EOI terms, including whether and when the money is refundable, are set by the developer. A property portal says EOIs are "usually refundable or partially refundable", but that is unverified for Dubai and should not be relied on.
| Question | Dubai | Abu Dhabi |
|---|---|---|
| Official EOI rule? | None found | Yes, announced 16 Feb 2026 |
| Where the money sits | Not confirmed | ADREC-supervised escrow |
| Registration | None found | Madhmoun platform |
| Refund mechanism | Developer's terms | Digital refund mechanisms (no amounts or dates given) |
Path 1: the project is in Abu Dhabi
Each emirate has its own property regulator and rules. Khaleej Times and Gulf News report that ADREC now requires developers of new off-plan projects to register investor EOIs on Madhmoun, with funds held in a government-managed preparatory escrow account. Ask the developer for the Madhmoun registration and raise the refund through that channel.
Path 2: Dubai, with written refund terms
Find the receipt, the EOI form and any email or message setting out refund conditions. A formal written demand that quotes those terms is the strongest first step. Give a clear deadline and keep a copy.
Example: a hypothetical form says the EOI is refundable within 30 days if no unit is allocated. Your demand quotes that sentence, the date paid and the date you asked, and requests payment to the original account.
Path 3: Dubai, with nothing in writing
Without written terms, your evidence is the payment itself and the messages around it. The DLD's FAQ says it can try to settle disputes but cannot cancel a contract; money claims go to the Dubai Courts. Our Australia guide to off-plan disputes explains which venue fits.
…refused to return the deposit on the grounds that the deposit is not refundable…
Path 4: EOI not refunded by a developer you cannot trace from Australia
If the payee was a personal account or a company you cannot trace, treat it as possible fraud. Speed matters more than the developer's reply, so the Australian steps below come first.

Use the home side for fraud response and record-keeping, and the Dubai side for the refund itself.
Collect the evidence
Receipt, EOI form, bank confirmation with the receiving account, and every message, saved as files with dates.
Send a written demand
Quote any refund terms and set a deadline. Time-stamp it in both Australian and Dubai time; the UAE is 7 hours behind Sydney during AEDT and 4 hours behind Perth all year.
Escalate by route
Settlement through the DLD, a claim in Dubai via a UAE-qualified lawyer, or, for a suspected scam, the bank and Scamwatch route above.

FAQ
Is an EOI refundable in Dubai for buyers in Australia?
An EOI in Dubai is refundable only if the developer's terms say so, because no official DLD or RERA rule on EOI refunds has been found. Buyers in Australia should locate the EOI form, receipt and any messages setting out refund conditions. Portal claims that EOIs are usually refundable are unverified for Dubai and should not be relied on.
Does Dubai EOI money go into an escrow account?
Dubai EOI money is not confirmed to go into escrow. The escrow law covers payments by buyers of off-plan units, but whether a pre-SPA EOI counts as such a payment has not been confirmed. Abu Dhabi differs: under rules announced in February 2026, ADREC requires EOIs to be registered on Madhmoun with funds in a supervised escrow account.
What should Australian buyers do if an EOI is not refunded?
Australian buyers whose EOI is not refunded should send a written demand citing any refund terms, with a deadline, and keep dated copies. If the developer does not respond, the DLD can attempt settlement, and money claims go to the Dubai Courts. If the payee cannot be verified, contact your bank immediately and report to Scamwatch.
Can Scamwatch get my Dubai EOI money back?
Scamwatch is the ACCC's channel for reporting scams; nothing in its guidance describes recovering money from a Dubai developer. Report there, use ReportCyber if money was stolen, and contact your bank immediately to ask it to stop the transaction. A refund itself comes from the payee, through settlement, a Dubai court claim, or a successful bank recall.
