Short answer
- A booking deposit refund from a Dubai developer, chased from Australia, turns first on whether an SPA was signed and registered.
- Before an SPA, refund terms are whatever the booking form says; no official Dubai rule on booking or EOI refunds was found.
- After an SPA, the deposit is part of the price: the developer must register the SPA in the Interim Property Register within 90 days, and an unregistered sale is void under Article 3(1) of Law No. 13 of 2008.
- If RERA cancels the project, Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, requires a full refund of all payments.
- The DLD can attempt settlement but cannot cancel a contract; refund claims go to the Dubai Courts, or arbitration if the SPA says so.
A booking deposit (or reservation fee) is the first payment that holds a specific unit. Its fate depends on where you are in the paperwork, and on what the project's public record shows.

Can buyers in Australia get a booking deposit refund from a Dubai developer?
Buyers in Australia can get a booking deposit back from a Dubai developer when the booking terms, the law on unregistered sales, or a project cancellation supports it. The route differs before and after the SPA.
The SPA (sale and purchase agreement) is the contract of sale. Oqood is the DLD's system for the Interim Property Register, where off-plan sales must be entered.
| Question | Before SPA | After SPA |
|---|---|---|
| What governs a refund | The booking form's terms | The SPA and Dubai law |
| Registration | None | Within 90 days of signing (DLD) |
| If RERA cancels the project | Ask under the booking terms | Full refund of all payments (Art. 11) |
| Walking away yourself | Depends on the form | Default rules in Art. 11 apply |
Branch 1: no SPA, but refund terms on the booking form
Quote the terms back in a dated written demand with a deadline. The booking form is your contract at this stage, so its words outweigh anything the sales team said.
He offered to return my money in instalments paid in post-dated cheques…
Branch 2: no SPA and no written terms
Without terms, your evidence is the payment and the conversation around it. Ask in writing for the refund and the reason for any refusal. The DLD can try amicable settlement; its FAQ says termination or money claims belong in the real estate court.
Branch 3: reservation fee refund after an SPA that was never registered
The DLD service page says the signed SPA "shall be registered in the provisional register within 90 days from the date of signing", and the buyer receives a provisional registration e-certificate by email. If no certificate arrived, the DLD FAQ says you can apply to its Real Estate Registration Assurance section.
Under Article 3(1) of Law No. 13 of 2008, an off-plan sale is void unless registered. MIO Law Firm notes that non-registration does not automatically rescind the contract.
Branch 4: the project was cancelled, or you want out
If RERA cancels the project by a final decision, every payment must be refunded under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020. If instead you stop paying, the developer may keep up to 25% of the unit value below 60% completion of the whole project, and up to 40% from 60%. Our guide to cancelling an off-plan contract from Australia sets out each exit.
Booking amount not refunded in Dubai? What buyers in Australia can do locally
The refund itself is a Dubai matter, but suspected fraud can be acted on at home. A slow developer is a dispute; a payee who has vanished may be a scam.
Pin down the paperwork stage
Booking form only, signed SPA, or SPA with an Oqood certificate. This decides the branch.
Write a dated demand
State the amount, date paid, receiving account and the rule you rely on.
Escalate in Dubai
DLD settlement for an agreed outcome; the Dubai Courts or arbitration for a refund claim, through a UAE-qualified lawyer.

FAQ
Is a reservation fee refundable in Dubai for Australia investors?
A reservation fee in Dubai is refundable for Australia investors only where the booking terms, the SPA or Dubai law provides for it. Before an SPA, the booking form's terms decide. After an SPA, Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, requires a full refund if RERA cancels the project.
What if my Dubai SPA was never registered in Oqood?
A Dubai SPA should be registered in the Interim Property Register within 90 days of signing, according to the DLD. If the provisional registration certificate never arrived, the DLD FAQ says the investor can apply to its Real Estate Registration Assurance section. Article 3(1) of Law No. 13 of 2008 makes an unregistered off-plan sale void.
Can the DLD order a developer to refund my booking deposit?
The DLD cannot cancel a contract at a buyer's request; its FAQ limits its role to amicable settlement, and a settlement it approves is binding. If the developer will not agree a refund, the buyer's claim goes to the Dubai Courts, or to arbitration where the SPA contains an arbitration clause.
Does Australia's AFCA cover a booking deposit paid to a Dubai developer?
AFCA's jurisdiction expanded on 12 March 2026 to cover complaints about receiving banks, even for non-customers. The available sources do not say this reaches a UAE bank receiving an Australian transfer, so do not assume AFCA can recover a booking deposit paid to a Dubai developer. Contact your own bank promptly if fraud is suspected.
