Paid cash for off-plan property in Dubai: next steps for Australia investors

Paid cash for off-plan property in Dubai? Australia investors can check the receipt, the escrow record and the AED 55,000 reporting rule, then act on gaps.

Short answer

  • If Australia investors paid cash for off-plan property in Dubai, the questions are whether the money reached the project's escrow account and whether you hold a receipt that proves it.
  • The DLD FAQ says "all amounts received from buyers of real estate units sold off-plan" go into the project escrow account.
  • Ministry of Economy Circular No. 05/2022 requires UAE-licensed brokers and agents to report cash payments of AED 55,000 or more on freehold deals; it is a reporting duty, not a ban on cash.
  • Since May 2024 several large Dubai master developers limit cash to AED 55,000 per transaction as a policy, not a law.
  • Under Article 16 of Law No. 8 of 2007, misappropriating money handed over for development can bring jail and/or a fine of at least AED 100,000.

Work out what your receipt proves, then match it against the official project record.

Official receipt held?

Australia investors who paid cash should secure an official receipt, confirm the money was deposited to the project's escrow account, and check that account against Dubai REST. Cash is lawful in Dubai property deals, but it is the hardest payment to trace later.

An escrow account is a bank account opened in the project's name under Law No. 8 of 2007; buyer payments go there and can be withdrawn only for defined purposes. Dubai REST is the Dubai Land Department's official app, which shows a project's escrow account number.

Branch 1: you have no official receipt

Ask in writing today for an official receipt showing the payer, the amount, the unit, the date and the account the cash was deposited into. A handwritten note or a chat message is weaker evidence than a company receipt.

Branch 2: the receipt shows an escrow account

Compare the account number with the escrow details in Dubai REST's Project Status (Mashrooi) service. If they match, keep tracking the paperwork: the SPA should be registered in the Interim Property Register within 90 days of signing. Our guide to verifying a Dubai escrow account from Australia walks through the lookup.

Branch 3: no account shown, or a mismatch

Treat the payment as possibly outside escrow until proven otherwise. The director of RERA's Real Estate Control Department has urged investors not to make payments outside the project's escrow account. The next steps are set out in money paid outside escrow, for buyers in Australia.

Cash payment at a sales office in Dubai: the rule buyers in Australia should know

The AED 55,000 rule is often misread as a cap. Circular No. 05/2022 makes UAE-licensed brokers and agents file a Real Estate Transaction Report (REAR) through the Financial Intelligence Unit's goAML platform when cash reaches AED 55,000 or more, or when virtual assets are involved. Records are kept for at least five years.

Example: a hypothetical buyer hands over AED 30,000 in cash on two visits, AED 60,000 in total. The circular counts single or combined payments, so the combined amount crosses the threshold.

FAQ

Is it legal to pay cash for off-plan property in Dubai?

Paying cash for off-plan property in Dubai is not banned by any verified UAE law. Ministry of Economy Circular No. 05/2022 requires UAE-licensed brokers and agents to report cash payments of AED 55,000 or more, and several large developers have limited cash to AED 55,000 per transaction as a policy since May 2024. Off-plan payments still belong in the project's escrow account.

What does the AED 55,000 cash rule mean for buyers in Australia?

The AED 55,000 cash rule means that UAE-licensed brokers and agents must file a Real Estate Transaction Report through goAML when cash on a freehold deal reaches AED 55,000 or more, single or combined. For buyers in Australia, it is a reporting duty on the agent, not a limit on the buyer, though some developers cap cash as policy.

How do I know if my cash deposit reached the escrow account?

A cash deposit reached the escrow account only if the developer's receipt or bank record shows deposit into the account listed for the project in Dubai REST's Project Status (Mashrooi) service. Ask for an official receipt naming the account. If no account appears or it does not match, treat the payment as possibly outside escrow and act on it.

Can I report a Dubai cash payment scam in Australia?

A suspected scam involving a cash payment in Dubai can be reported in Australia to Scamwatch, run by the ACCC, and to ReportCyber if money or personal information was stolen. IDCARE helps with identity misuse. Recovering the cash itself runs through Dubai, usually with a UAE-qualified lawyer, since DFAT cannot intervene in commercial disputes.
