Short answer
- Cancelled real estate project in Dubai, now in liquidation? Buyers in Australia deal with a single Dubai body set up under Decree No. 33 of 2020.
- That body's rulings cannot be appealed, and neither the ordinary Dubai courts nor the DIFC Courts can take these cases instead.
- Money comes out of the project's escrow account and is split among verified buyers, fully if it stretches that far, pro rata if not.
- The Dubai Land Department (DLD) gives no end date: it calls the timeline indefinite.
- From Australia, the job is mostly paperwork, usually through a UAE-qualified lawyer.

Cancelled real estate project, Dubai liquidation: where buyers in Australia stand
Liquidation begins when a cancellation refund has not simply been paid. A Dubai tribunal and the DLD then divide the escrow balance between buyers.
Escrow is the single-project bank account into which Dubai Law No. 8 of 2007 directs off-plan payments. RERA, the DLD's regulator, is the body that cancels projects.
Branch 1: your project sits with the Special Tribunal
For Australian buyers, the special tribunal for cancelled projects in Dubai is the only door. Its full name is the Special Tribunal for Liquidation of Cancelled Real Property Projects, announced by the Dubai Media Office in December 2020.
| Feature | 2013 committee | 2020 Tribunal |
|---|---|---|
| Created by | Decree No. 21 of 2013 | Decree No. 33 of 2020 |
| Status today | Replaced | In force |
| Covers | Cancelled projects | Unfinished, cancelled and liquidated projects |
| Enforcement | — | Execution Court of the Dubai Courts |
The Chairman of the Dubai Judicial Council appoints its members, and it can instruct escrow trustees.
Branch 2: escrow liquidation, followed from Australia
What gets shared is the remaining balance, not the total paid in. The DLD's liquidation section draws on the project escrow account and pays out "in full or proportionally".
Example: if a hypothetical escrow account holds AED 6 million against AED 10 million of verified claims, each buyer would receive 60% of their claim. Real ratios differ project by project.
…I have yet to see the funds despite repeatedly pressing the claims…
Shortfalls beyond escrow are harder. Hadef & Partners wrote in 2010 that buyers may end up as unsecured creditors of the developer once escrow is exhausted.
Branch 3: you are unsure the project has reached liquidation
Confirm the cancellation itself first. Gulf News (2023) reports that the DLD's Dubai REST app labels projects active, finished or cancelled; foreign investors sign in with UAE PASS or a title deed.
A fresh cancellation has earlier steps, a 14-day escrow refund and a 60-day developer deadline, set out in our refund guide for Australia investors.
Building a liquidation claim from Australia
The DLD can only count you once your file is complete. Most of what it needs can be gathered and certified without leaving Australia.

Schedule follow-ups around the gap. Until 4 April 2027, Sydney runs 7 hours ahead of Dubai and Perth 4.
Tax pointer: the ATO notes that residents declare worldwide income and that CGT may apply to overseas assets. Ask a registered tax adviser about a payout; this is general information only.
A historical benchmark
Liquidations in the crisis era were slow and partial. Gulf News reported in 2018 that Dubai Courts records listed more than 150 cancelled projects, mostly launched 2005–2008, with cases running about 2–4 years.
Those numbers belong to 2008–09. Since 2020 the law starts from a full refund, but recovery still tracks escrow.
If the developer has gone silent, see the paper trail when the developer stops replying, or where an off-plan dispute goes from Australia. The general explainer is cancelled project liquidation in Dubai; all Australia guides sit on the Australian buyers' hub. You can look up a project's registry record any time.
