Sell off-plan before handover in Dubai: a resale guide for Australian buyers

Sell off plan before handover in Dubai? Australian buyers: the NOC, typical 30–40% paid thresholds, fees, and the ATO and AUD points to plan for.

Short answer

  • Can you sell off-plan before handover in Dubai? Australian buyers can, once the purchase is on the Dubai Land Department's (DLD) off-plan register.
  • The developer's No Objection Certificate (NOC) comes first; without it, no transfer to a new buyer happens.
  • SPAs commonly set a paid-up share, often 30–40%, that must be reached before a NOC; that figure is the developer's, not the law's.
  • Beyond admin costs the DLD has approved, developers cannot charge you for a resale.
  • On the Australian side, the ATO says CGT may apply to a gain on an overseas asset.

Sell off-plan before handover in Dubai: can Australian buyers do it?

Yes, provided two things are in place: registration and a developer NOC. Dubai's interim register law expressly lets owners of registered off-plan units sell or mortgage them (Law No. 13 of 2008, Art. 6).

"Registered" means entered on the DLD's Interim Property Register through Oqood, its self-registration system. Under Article 3(1), any sale that skips that register is void.

Branch 1: no registration yet

Sort this out before marketing anything. It is the developer's job to register: the DLD's initial-sale service sets a 90-day deadline from SPA signing, and the buyer is emailed a provisional registration e-certificate.

Where a developer stalls, investors can take supporting papers to the DLD's Real Estate Registration Assurance section.

Branch 2: below the developer's paid-up minimum

The minimum lives in your SPA. Press reports from 2018 trace these thresholds to late 2017, with most developers at roughly 30% and some at 40%.

Example: a hypothetical AED 1,500,000 unit with a 40% rule needs AED 600,000 paid before a NOC request. A seller at AED 450,000 must find another AED 150,000 first.

Branch 3: minimum reached — off-plan resale rules for selling from Australia

The NOC opens the gate; the DLD transfer walks through it. According to the DLD FAQ, handing the unit or the deferred sale contract to someone else requires the developer's No Objection Certificate beforehand.

  1. Reread the resale clause

Note the minimum paid share and any listed fees.
  2. Ask for the NOC in writing

Attach payment proof and date the request in UAE time; Sydney is 7 hours ahead until 4 April 2027.
  3. Check where the buyer pays

Money owed to the developer goes into project escrow; confirm the account number in Dubai REST.
  4. Transfer at the DLD

The incoming buyer takes over the Oqood registration.

One fee rule is statutory. Article 7 of the 2008 law limits what a developer may charge on a resale to admin costs the DLD has signed off. The 4% transfer figure has no DLD off-plan service page behind it, so read it as typical.

Branch 4: the developer refuses

Ask for the reason in writing and test it against your SPA. The guide to a refused NOC for Australia investors lines up what the law says against typical contract wording.

How Australia investors assign an off-plan contract in Dubai: the home-side checks

Dubai sets the process; Australia sets your paperwork. If a Dubai broker markets your unit, its advert should carry a Madmoun QR code, mandatory from 24 April 2023, which shows the permit is valid.

Keep AUD records from day one. A CGT calculation needs the AUD value of each instalment when paid and of the proceeds when received; bank statements are the cleanest proof.

Resale questions from Australia

Off-plan resale in Dubai: which rules apply from Australia?
Selling from Australia changes nothing about Dubai's off-plan resale rules. A registered unit may be sold under the 2008 interim register law, the developer's NOC is required first, and many SPAs add a paid-up minimum, often 30–40%. The DLD then records the transfer.
Assign an off-plan contract in Dubai: can Australia investors do it remotely?
Much of an assignment can be run from Australia: the NOC request, the terms and the escrow check all work by email and app. Whether a DLD step needs you in person or a power of attorney is a question for the developer, the DLD or a UAE-qualified lawyer.
What does a Dubai off-plan resale cost?
A Dubai off-plan resale usually carries a developer NOC fee, which Khaleej Times put at AED 1,000–5,000 plus VAT in 2022, and a DLD transfer fee that secondary sources give as 4% of the new price. Dubai law bars developers from charging further resale fees beyond DLD-approved admin costs.
Is a Dubai off-plan resale taxed in Australia?
A Dubai off-plan resale by an Australian resident may attract Australian capital gains tax, the ATO says, and residents must declare worldwide income. Foreign tax actually paid may qualify for a foreign income tax offset. This is general information, so confirm your position with a registered tax adviser.
