What to check before handover in Dubai when you live in the UK

What to check before handover in Dubai from the UK: snagging by proxy, area shortfalls over 5%, the 5% escrow retention and when the title deed is issued.

Short answer

  • What to check before handover in Dubai from the UK starts with area: the DLD FAQ says extra area is not charged unless your contract says so, and developers must compensate where the shortfall exceeds 5%.
  • From the completion certificate, 5% of the project's escrow account is held back until 12 months after owners' units are registered (Article 14, Law No. 8 of 2007); the DLD ties it to defect repairs.
  • Per the DLD FAQ, no title deed is issued until the finished project is registered by the developer and your unit is paid in full.
  • Snagging is not legally required in Dubai, but a UK owner can arrange it through someone on the ground before signing anything.

The completion email has arrived, and you are in Britain. Your checks fall into four areas: defects, square footage, the escrow holdback, and the registration behind your title deed.

What to check before handover in Dubai from the UK: where do I start?

Start with the paperwork, then the property. Ask the developer for the completion documents and your final statement of account, and compare the unit area quoted there with the area in your SPA (sale and purchase agreement, the contract you signed off-plan).

Article 8 of Dubai Law No. 13 of 2008 obliges a developer holding a completion certificate to record the finished project in the Property Register. Keys in hand do not mean a deed; that registration comes first.

Can I arrange snagging before handover from Britain?

Yes, through a representative. Snagging means a detailed inspection for defects before you accept the unit; no Dubai statute requires it, yet property portals suggest holding back your signature on acceptance until the developer has confirmed the defects list in writing.

  1. Appoint someone on site

Choose an inspector or trusted contact in Dubai and give them written authority limited to inspecting, not signing.
  2. Request a dated report

Ask for photos, room-by-room notes and measurements, sent to your UK email so the timestamps sit in your records.
  3. Send the list to the developer

Forward the defects in writing and ask for written acknowledgement before any acceptance form is signed.
  4. Hold the signature

Sign the handover acceptance only once the acknowledgement is in your inbox.

What happens if the flat is smaller than the SPA says?

Area differences are settled by contract and DLD rules. Per the DLD FAQ, additional square footage can be billed only where the contract permits, while a shortfall of more than 5% entitles the buyer to compensation.

Example: an SPA lists 1,000 sq ft and the measured unit is 940 sq ft. That is a 6% shortfall, which passes the 5% line in the DLD FAQ, so you would put the measurements to the developer in writing.

Why does the 5% escrow retention matter to me?

It is the money set aside for defects. Article 14 of Dubai Law No. 8 of 2007 has the escrow agent hold back 5% of the account's total value from the date of the completion certificate; the developer gets it 12 months after owners' units are registered. Because the DLD links this holdback to defect repairs, raise any defects within those 12 months.

When will the title deed be issued?

Two things must happen first: the developer has to register the finished project, and you must have paid for the unit in full. Only then, per the DLD FAQ, does the property pass to the Real Estate Registry with a deed issued in your name.

The 4% DLD registration fee is normally charged at the earlier Oqood stage (Oqood is the DLD's interim register for off-plan sales), not at handover, so query any request to pay it again.

Handover checklist for British buyers

Who in the UK can help if handover goes wrong?

UK bodies can point you to help but cannot act for you. The FCDO says it cannot intervene in private legal matters overseas, though its "Find a professional service abroad" lists include English-speaking lawyers, with the caveat that they are not recommendations.

Pay any final balance only after confirming the account through details you already hold, because a UK-to-UAE transfer falls outside the APP reimbursement scheme.

Before you sign, run the project's registry check once more. See also the UK guide to the Service Charge Index, the UK page on checking construction progress, the global handover guide, and the UK buyers' hub.

How does snagging before handover in Dubai work for UK investors?
UK investors usually appoint an inspector or trusted contact in Dubai to inspect the unit, photograph defects and send a dated report. The defects list then goes to the developer in writing. Snagging before handover in Dubai is optional in law, but signing only after the developer confirms the list keeps a clear record.
What belongs on a handover checklist for Dubai off-plan as British buyers?
A handover checklist for British buyers of Dubai off-plan should cover the final statement of account, measured area against the SPA, a written defects list, the approved service charge, the date the completed project was registered, and proof the unit is fully paid. The last two matter because the DLD issues the title deed only after both.
Can the developer charge me for extra square footage at handover?
Only if your contract allows it. The Dubai Land Department FAQ says extra area is not charged unless the contract provides for it. The same FAQ says the developer must compensate the buyer where the unit's area falls short by more than 5% of what was agreed.
How long is the 5% escrow retention held in Dubai?
Article 14 of Dubai Law No. 8 of 2007 sets the escrow holdback at 5% of the project account's total value from the completion certificate. The developer receives it 12 months after owners' units are registered. The Dubai Land Department links this 5% holdback to the repair of defects, so owners should report problems within that period.
Do I pay the 4% DLD fee again at handover?
Normally no. The 4% DLD registration fee is charged at the off-plan registration stage through Oqood, typically when the SPA is signed. The DLD splits it between seller and buyer, though in practice the SPA usually puts it on the buyer. Ask for a written breakdown if a handover invoice includes it.
